Virginia is one of the few remaining jurisdictions in the country that adheres to the strict doctrine of “pure contributory negligence.” This rule is a significant hurdle for injury victims because it provides that if a jury finds a plaintiff even 1% responsible for the incident, the law bars that individual from any financial recovery. Insurance representatives often use this rule to deny claims entirely.

Updated liability limits
As of January 1, 2025, all motor vehicle liability policies issued or renewed in Virginia must meet higher mandatory minimums. These limits represent a much more robust starting point for your recovery compared to the previous limits. The current 2026 requirements are:
- $50,000 for bodily injury or death of one person
- $100,000 for bodily injury or death of two or more people in any one accident
- $25,000 for property damage

The end of the uninsured motorist (UMV) fee
Historically, Virginia allowed drivers to bypass insurance by paying a $500 Uninsured Motorist Vehicle fee to the DMV. As of July 2024, this fee has been abolished. Every registered vehicle in Virginia must now be covered by a liability policy. For victims hit by the remaining uninsured drivers on the road, this change clarifies insurance obligations. Eliminating the “UIM offset” (stacking your coverage)
One of the most pro-consumer changes in Virginia law involves Underinsured Motorist (UIM) coverage. Previously, insurance companies could “offset” or subtract the at-fault driver’s policy from your own UIM limits. That is no longer the case. You can now “stack” these coverages to access the full pool of available funds.
Example: If you have $100,000 in UIM coverage and are hit by a driver who only carries the minimum $50,000 policy, you are no longer capped at $100,000. Under current law, you can access the at-fault driver’s $50,000 plus your $100,000, for a total of $150,000 in available coverage.
Filing Deadlines: Act Before Time Runs Out
In Virginia, time is limited. According to Va. Code § 8.01-243, an individual must file a lawsuit for personal injury within two years of the accident date. Similarly, under Va. Code § 8.01-244, a wrongful death claim must be filed within a two-year window from the date of the loved one’s passing.
